                                Natick Conservation Commission
                                                     September 6, 2007


        The Meeting was called to order at 7:00 by Chairman, Matthew Gardner.  Members present:  George Bain, Adrienne Spelker, Kathy Rehl, Doug Shepard


Request for Determination – 39 Jennings Pond Road
Matthew Gardner read public hearing notice.  Homeowners, Edward & Eujin Neilan, would like to add an addition within the buffer zone.  The commission requested the applicant install hay bales and silt fencing.

Kathy Rehl moved to close and issue a Negative 3 Determination, Doug Shepard seconded, all in favor 5-0.

Request for Determination – 10 Woodland Street
Matthew Gardner read public hearing notice.  Heidi Gomez, homeowner, would like to add an attached garage.  Mr. Gardner visited the area and stated it is a previously disturbed lawn and driveway.  No change in pervious area.  

Kathy Rehl requested erosion control be pulled in close to addition.  Commission also requested two signs on hay bales reading “no materials beyond erosion control”.  The Commission would like to have this sign be standard operating procedure.

Kathy Rehl moved to close and issue a Negative 3 Determination with 2 conditions:

1.      Erosion control 10 feet from corner of proposed building
2.      2 signs on hay bales stating no materials beyond erosion control.

Adrienne Spelker seconded, all in favor 5-0.

Notice of Intent – 2 Front Street
Matthew Gardner read public hearing notice.  Peter Heffernan and his wife would like to demolish their existing non-conforming two family dwelling near a stream the commission recognizes as perennial.  The intent is to rebuild the house to conform to all current setback requirements.  Kathy Rehl requested planting list.  Mr. Heffernan stated their will be 4 recharge basins on property, and cobblestones placed in the front.

Commission agreed on a site visit at 12:00 noon on Sunday, September 16th.  Adrienne Spelker moved to continue until September 20th, Kathy Rehl seconded, all in favor 5-0.

Notice of Intent – Newfield Drive.
Matthew Gardner read public hearing notice.  Brian Nelson, from Metrowest Engineering,          reviewed proposal to repave road, replace cracked berm, one tree removed.  Not creating any additional impervious areas.  When complete, looking for town to accept as a town road.  Brian reviewed with Mark Coviello and stated Mr. Coviello did not feel a Stormwater Management application needed to be filed.  Mr. Bois felt an EPA permit and Land Disturbance permit would be required.  The entire sewer will be relined, but no excavation is expected.  80% of drainage on road will be replaced.  

Mr. Gardner would like to see a catch basin maintenance plan before the town accepts.  Who would be responsible and when.  

Commission agreed on a site visit at 1:00 p.m. Sunday, September 16th at Route 135 end of Newfield Drive.

George Bain moved to continue to September 20th, Kathy Rehl seconded, all in favor 5-0.

St. Mark’s Coptic Church
Doug Shepard recused himself as he voted against Planning Board’s decision.  Mr. Bois read Mark Coviello’s letter into record.  

Mr. Gardner recommended to Planning Board that they approve APD special permit, so moved by George Bain, Adrienne Spelker seconded, and Kathy Rehl abstained, 3-0-1.  Bob Bois will make recommendation to Planning Board.   

Doug Shepard returned.

Notice of Intent continuation – Oxford St./Wellesley Ave., Lot 63
Kathy Rehl moved to continue to September 20th, George Bain seconded, all in favor 5-0.

Notice of Intent continuation – Oxford St./Wellesley Ave., Lot 166D
Kathy Rehl moved to continue to September 20th, George Bain seconded, all in favor 5-0.

Notice of Intent continuation – 17 Davis Brook Drive
Richard Cebula., property owner, is proposing to extend is yard.  Would be encroaching 100 ft, but not 50 ft.  Would need a 4-6 ft retaining wall.

Commission agreed to visit site on Sunday, September 16th, at 11:30 a.m.

Kathy Rehl moved to continue to September 20th, Adrienne Spelker seconded, all in favor 5-0.

Request for Determination – Natick Army Labs, Kansas Street – NSTAR gas pipe
John McHugh, representing Army Labs, reviewed proposal to install NSTAR gas lines.  

Doug Shepard moved to close and issue a Negative 3 Determination, George Bain seconded, all in favor 5-0.

Order of Conditions extension – 33 Glen Street, Lot 2A
George Bain moved to issue a 3 year extension, Doug Shepard seconded, all in favor 5-0.


Certificate of Compliance – 20 Robinhood Road – 233-236
Bruce Ey, Schoefeld Bros, reviewed 1980 project to replace 35 stairs against Lake Cochituate, but homeowners never applied for COC.  Visited site and stairs are in compliance, no erosion.

George Bain moved to issue Certificate of Compliance, Kathy Rehl seconded, all in favor 5-0.


Open Space
Open Space Committee voted on Wild Meadow and will report on second parcel, Austin Way, after site walk

Certificate of Compliance – Woodland Village – 233-427
Kathy Rehl moved to issue Certificate of Compliance, George Bain seconded, all in favor 5-0.

Certificate of Compliance – 226 South Main Street – Bruchu Bros.
Mr. Bois read letter from Joe Sullivan stating project was not in compliance.  Illegal filling of wetlands.  Commission agreed that Bob Bois will contact tenant and owner of property.
